The petitioner is languishing in custody since 29.09.2018 in a case for the offence registered under Sections 341, 323, 384, 386, 427, 504 and 506/34 of the IPC. The prosecution story, in brief, is that when the informant alongwith his two children was plucking Mangoes from his Garden, Pramod Yadav (petitioner), co-accused Aamod Yadav, Sunil Yadav and 4-5 others armed their having Gun in their hands started firing blindly. The informant and his family members ran away from the place of occurrence to save them. It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present
Patna High Court CR. MISC. No.13118 of 2019(2) dt.02-05-2019 2/2 case. There is no allegation of tampering with the witnesses alleged against the petitioner. There is no substantive evidence to suggest the implication of the petitioner in the present case. No Rangdari is alleged to have been demanded by the petitioner. General and omnibus allegation has been made against the petitioner. It is further submitted that the petitioner may be released on bail after completion of nine months in custody. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of nine months in custody on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Jhanjharpur, in connection with Phulparas P.S.
