The prayer for bail on behalf of the petitioner was earlier rejected vide order dated 02.12.2013 passed in Cr. Misc. No. 15469 of 2013.

A report has been called for and it has been stated that all witnesses have been examined except the doctor, Investigating Officer and one another witness. Hence, the Superintendent of Police, Gopalganj is directed to ensure the attendance of the witnesses on the date fixed so that the witnesses be examined within two months. If the witnesses are not produced then the Superintendent of Police, Gopalganj shall give reason to the trial Court and the trial Court shall pass order for immediate production of the witnesses or shall take a decision to close the case or to ensure the attendance of the

No.32183 of 2014 (3) dt.30-09-2015 witnesses and if the witnesses are not produced by the Superintendent of Police, Gopalganj then the Superintendent of Police, Gopalganj shall be held responsible for the laches and the trial Court shall pass order on the bail petition filed by the petitioner fixing responsibility for non-compliance of the order. However, if the three witnesses are examined then the trial Court shall dispose of the case within one month.

Let a copy of the order be communicated to the Superintendent of Police, Gopalganj as well as to the Court concerned.
