The petitioner is accused in connection with Pasraha P.S. Case No. 118 of 2016 registered under Sections 399, 402, 353 and 307 of the Indian Penal Code and Section 25(1-b)a, 26, 27 and 35 of the Arms Act.
The accusation is that while on seeing the police party six persons succeeded to flee away but the petitioner was apprehended. On search, one country made pistol and six live cartridges were recovered from possession of the petitioner. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 15.09.2016.
Having regard to the facts and the circumstances of
Patna High Court Cr.Misc. No.1774 of 2017 (2) dt.19-01-2017 the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Pasraha P.S. Case No. 118 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
