The petitioner seeks bail in connection with Muffasil P.S. Case No. 56 of 2019, registered under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
The accusation is that informant Bikash Kumar along with his cousin brother Vipul Kumar Yadav, Ajay Kumar Yadav @ Pappu Yadav, Dipak Yadav and Gaurav Kumar Yadav were returning in the night of 14/15-02-2019 after attending the Tilak ceremony, in the way, five persons named in the F.I.R., including the petitioner, having firearm in their hand came there and asked to stop the motorcycle. At that time, Santosh Yadav @ Munnabir shot fire at the informant,

No.9462 of 2020(2) dt.27-02-2020 2/2 while he tried to move with the motorcycle, but Sagar Yadav and Badal Yadav also fired, which hit to his cousin brother Vipul Yadav, anyhow, all fled away from there. Learned counsel for the petitioner submits that while the petitioner is named in the F.I.R., but there is no allegation of making firing against the petitioner either on informant or anyone. The petitioner has no criminal antecedent and he is in custody since 16.11.2019. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Muffasil P.S.
