In the nature of the relief so prayed in the writ petition, it would not require to await filing of the counter affidavit.

The petitioner prays for appropriate directions to the concerned respondent authorities for passing appropriate orders on the sale deed presented for registration dated 30.12.2015 together with the requisite fees, a copy of which is enclosed at Annexure-2 to the writ petition. According to the petitioner, the matter remains pending before the Sub Registrar, Gogri, Khagaria for disposal since 30.12.2015.

Having heard learned counsel for the parties and

Patna High Court CWJC No.1270 of 2016 (2) dt.02-12-2016 considering the nature of relief prayed herein, I deem it fit and proper to direct the District Sub Registrar, Gogri, Khagaria to consider the grievance of the petitioner regarding the non registration of the sale deed pending since 30.12.2015 and dispose of the same accordingly within a period of four weeks from the date of receipt/production of a copy of order. It goes without saying that in case the District Sub Registrar has reservation about the registration of the sale deed in question, he shall dispose of the same by a speaking order to be passed after opportunity of hearing to the petitioner.
