JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 20-02-2019 Heard learned counsel for the petitioner, no one appears on behalf of the State to oppose this application. Petitioner is seeking anticipatory bail in connection with Sheikhpura P.S. Case No. 581 of 2018 (POCSO Case No.35 of 2018) registered for the offences punishable under Sections 366 A and Section 34 of the Indian Penal Code and Section 8 of the POCSO Act.

Learned counsel for the petitioner submits that the petitioner is the mother of the boy with whom daughter of the informant has allegedly gone and is presently missing. It is submitted that both the boy and the girl are of tender age and both of them have not returned as yet, there is no role of this petitioner to play in the affairs between the boy and the daughter of the informant.

No.10327 of 2019(2) dt.20-02-2019 2/2 Considering the facts and circumstances of the case, particularly, that the petitioner is a lady and mother of the boy with whom the daughter of the informant is said to have gone, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District and Sessions Judge, Sheikhpura in connection with Sheikhpura P.S. Case No. 581 of 2018 (POCSO Case No.35 of 2018), subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
