The petitioners apprehend their arrest in Turkauliya P.S. Case No. 364 of 2016 instituted for the offence under Section (s) 147, 148, 149, 341, 323, 324, 307 of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted on behalf of the

Patna High Court Cr.Misc. No.7904 of 2017 (2) dt.23-02-2017 2/2 petitioners that the occurrence took place in the background of land dispute. There is general and omnibus allegation against the petitioners except petitioner No. 5 Vicky Thakur who is alleged to have assaulted Bal Krishna Yadav on his head, however, there is no description in the First Information Report as by which weapon petitioner No. 5 assaulted Bal Krishna Yadav. From the order of the learned Sessions Judge also, it does not appear that any injury report has been submitted with regard to the injury of Bal Krishna Yadav. In the facts and circumstances of the case, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, above named, within six weeks from today in connection with Turkauliya P.S. Case No.

364 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
