Mr.Ram Anurag Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-03-2020 Heard the learned counsel for the petitioners and the learned APP for the State.
The petitioners apprehend their arrest in connection with Ladipur P.S. Case No. 142 of 2019 for the offence punishable under Sections 307, 379 and other allied Sections of the Indian Penal Code.
The allegation is regarding the accused persons having assaulted the informant and her family members. As far as the petitioners are concerned, there is specific allegation of them having assaulted the informant and her son as also the daughter of the informant.
The learned counsel for the petitioners has submitted
Patna High Court CR. MISC. No.9010 of 2020(2) dt.03-03-2020 2/3 that the petitioners are innocent, are having clean antecedent and have been falsely implicated in the present case. It is further submitted that the impugned order dated 03.10.2019 passed by the learned 5th Additional Sessions Judge, Bhagalpur would show that the injuries sustained by the prosecution party are stated to be simple in nature, caused by hard and blunt substance. It is further submitted that the petitioners are having deep roots in the society and would definitely join the ensuing investigation as also the trial, if any.
Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners, coupled with the fact that the petitioners are having a clean antecedent, I deem it fit and proper to direct for release of the petitioners on anticipatory bail.
Accordingly, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners, above named, are directed to be released on anticipatory bail on furnishing bail- bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Lodipur P.S. Case No. 142 of 2019, subject to the conditions laid down under
