JUSTICE BIRENDRA KUMAR ORAL ORDER 20-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 409/420 of the Indian Penal Code.
Allegation is of embezzlement of public money in payment of labour charges under MANREGA scheme. Submission of the petitioner is that petitioner is in custody 27.11.2016 and in the pending departmental proceeding it has come that there is no case of defalcation of public money. Moreover, similarly situated other co-accused have been allowed bail by the learned Court-below.
Considering the facts aforesaid, let petitioner,
Patna High Court Cr.Misc. No.3614 of 2017 (2) dt.20-02-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipur, Darbhanga/Successor Court, in connection with Bahera P.S. Case No. 12 of 2011.
