2. The petitioner apprehends his arrest in connection with K. Hat P.S. Case No. 316 of 2024 registered for the offence punishable under Sections-420, 467, 468, 471 of the Indian Penal Code.

3. According to allegation, the petitioner has obtained a licence for Medical Store and, is running a Medical Shop on the basis of forged Pharmacist Certificate.

4. Mr. N. K. Agrawal, learned Senior counsel for the petitioner has submitted that the petitioner has been running his Medical Shop since 1985. He is a person of clean antecedent. There is no allegation on the petitioner of selling or storing of spurious drugs. The only allegation against the petitioner is that on the basis of forged pharmacist certificate, he has been

Patna High Court CR. MISC. No.11859 of 2025(4) dt.22-09-2025 2/2 running the Medical Shop. Learned counsel has also submitted that if the petitioner is granted anticipatory bail, he would not apply for renewal of licence of his shop till final outcome of the criminal case.

5. Learned counsel appearing for the State has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances as well as clean antecedent, let the petitioner named above, in the event of arrest/surrender within four weeks before the court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with K. Hat P.S. Case No. 316 of 2024 subject to the conditions as laid down u/S 438(2) of the Cr.P.C.

7. The petitioner, according to his adherence, will not apply for renewal of licence of his shop till final outcome of the criminal case, unless he satisfies the authority which granted the licence that he was having a valid and genuine certificate of Pharmacy.
