====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends arrest in Lakhisarai P.S. Case No. 166 of 2013 dated 12.05.2013 instituted under Sections 420/468/470 of the Indian Penal Code. The allegation against the petitioner along with two other co-accused i.e., his father and brother is that they had got signature done of informant on various papers including cheques and had fraudulently withdrawn Rs. 16,000/- from his bank account from the bank in which the father of the petitioner is employed. Learned counsel for the petitioner submits that without going into the merits of the matter, earlier the Court by order dated 18.07.2013 in Cr. Misc. No. 29452 of 2013 had granted anticipatory bail to the father and brother of the petitioner on the condition that they would return Rs. 16,000/- to the informant. It is submitted

Patna High Court Cr.Misc. No.33203 of 2014 (3) dt.07-10-2015 2/2 that pursuant to the same, they have also been enlarged on anticipatory bail. It is further submitted that the petitioner has no criminal antecedent.

Learned A.P.P. in view of the earlier order of the Court dated 18.07.2013 in Cr. Misc. No. 29452 of 2013, with regard to grant of anticipatory bail to the father and brother of the petitioner is not in a position to oppose the application.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in Lakhisarai P.S.
