JUSTICE SANJAY PRIYA ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bihpur P.S. Case No. 229/2016 instituted for the offence under Sections 147, 148, 324 and 307 of the Indian Penal Code and 27 of the Arms Act. There is allegation against this petitioner that the firing made by this petitioner caused injury in Panjra of the informant and the firing done by Girdhari @ Gopal Kumar did not hit the informant.

The learned A.P.P. has pointed out that in para 90 of the case diary a circular wound(wound of entry) over left side of abdomen and also one incised wound (wound of exit) caused by firearm was found on the Panjra of the informant which was
Patna High Court Cr.Misc. No.1176 of 2017 (3) dt.17-03-2017 2/2 grievous in nature Under such circumstances, this court is not inclined to grant bail to the petitioner. Accordingly, prayer for bail of the petitioner is rejected. However, the petitioner may renew prayer for bail after six months, if no substantive progress is made in the trial.
The trial court is directed to expedite the trial of the accused persons.
