The present application has been preferred with a prayer to grant regular bail in connection with Trial No. 1309 of 2014 arising out of Complaint Case No. C-1/248 of 2013, wherein cognizance has been taken for the offences punishable under Section 498(A) of the Indian Penal Code. The petitioner was in custody since 25.08.2014, but a co-ordinate bench of this Court vide order dated 03.03.2015 granted provisional bail for a period of two months and the matter was referred for mediation to the Mediation Centre, Patna High Court. The interim report of
Patna High Court Cr.Misc. No.49905 of 2014 (4) dt.25-07-2016 Mediator kept at 'Flag-C, dated 29.04.2015 reflects that both sides are ready to compromise but it will take some time to resolve the issue.
It is submitted by the learned counsel for the petitioner that both sides have decided to part ways though notices were not issued to the complainant, but in pursuance to order dated 03.03.2015, she appeared for mediation proceeding. Considering the nature of accusation, report of Mediator, statement of counsel for the petitioner and the period of custody before granting interim bail, the interim bail is hereby confirmed in connection with Trial No. 1309 of 2014 arising out of Complaint Case No. C-1/248 of 2013, for which the petitioner has already furnished the bail bonds.
