JUSTICE ANIL KUMAR SINHA ORAL ORDER 14-07-2021 Heard Mr. Krishna Prasad Singh, learned senior counsel for the petitioner and Mr. Matloob Rab, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks anticipatory bail in connection with Nokha P.S. Case No. 133 of 2019 (POCSO Case No. 118 of 2019) registered for the offence punishable under Sections 376, 314, 304, 120(B) of the Indian Penal Code, 1860 and Section 4 of POCSO Act.

This is second attempt for grant of anticipatory bail on behalf of the petitioner. This Court vide order dated 29.9.2020 had rejected anticipatory bail of the petitioner on merit after taking into consideration the materials on record and also the

Patna High Court CR. MISC. No.20745 of 2021(2) dt.14-07-2021 2/2 fact that the petitioner is not a qualified Doctor. It appears that the petitioner instead of seeking regular bail, has again preferred anticipatory bail and no new material has been placed before this Court for consideration of second anticipatory bail application of the petitioner.

Accordingly, this Court is not inclined to entertain this second anticipatory bail preferred on behalf of the petitioner and the same is rejected.
