JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-02-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 406, 120(B) of the Indian Penal Code.
Earlier the prayer for bail of the petitioner was rejected at infancy stage of the investigation but now petitioner is in jail custody since 21.12.2015 and up till now, his trial could not be concluded. Moreover, the impugned order goes to show that petitioner was driver of the concerned vehicle and one co-accused disclosed this fact that petitioner was in connivance with him to commit the crime in question.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.2840 of 2017 (2) dt.22-02-2017 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Patepur P.S. Case No. 144 of 2015.
