JUSTICE BIRENDRA KUMAR ORAL ORDER 15-03-2017 Heard learned counsel for the petitioners and learned APP for the State.
Petitioners are languishing in custody in connection with Bishanpur P.S. Case No.86 of 2016 for offences punishable under Sections 363/366A/120B/34 of the Indian Penal Code.
Two minor daughters of the informant namely, Nisha Kumari, aged about eleven years, and Saloni Kumari, aged about five years, were found missing. Thereafter F.I.R. was lodged against unknown. On recovery of both the girls, the statement of Nisha Kumari was recorded, under Section 164 Cr.P.C., wherein she stated that she had voluntarily left her house. Patna High Court Cr.Misc. No.2616 of 2017 (3) dt.15-03-2017 2/2 took her in a temple and married with her. Thereafter both lived at different places including at Delhi. She has not alleged anything against the petitioners.
Considering the facts aforesaid, let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Darbhanga, in connection with Bishanpur P.S. Case No. 86 of 2016.
