Petitioner is accused in connection with Katra P.S. Case No. 97 of 2016 corresponding to G.R. No. 4978 of 2016 registered under Sections 272, 273 of the I.P.C. and section 47, 51, 52, 53, 54 and 57 of the Bihar Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is a Tempo Driver, who is innocent and has falsely been implicated in this case. It is also submitted that petitioner has no criminal antecedent and is in custody since 12.12.2016.

Having considered the period of custody and facts and circumstances of the case, let the above named petitioner be

Patna High Court Cr.Misc. No.5384 of 2017 (3) dt.10-03-2017 2/2 released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M., 1st Class, Muzaffarpur in connection with Katra P.S. Case No. 97 of 2016.
