JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bodh Gaya P.S. Case No. 366 of 2016, registered under Sections 279 and 304 of the Indian Penal Code.

The accusation is that informant along with her son and sister's daughter boarded in the Tempo, which was being driven by one Santosh Kumar. In the way, Santosh Kumar permitted to the petitioner to drive the Tempo. While complaint was made by the informant about rash driving of Tempo by this petitioner but Santosh Kumar did not take any heed and the Tempo met with an accident, in which, her son fell down on the road and her Sister's daughter sustained injury, who died in course

Learned counsel for the petitioner submits that coaccused, Santosh Kumar has been granted privilege of bail by a Bench of this Court vide order dated 17.01.2017 passed in Criminal Misc. No. 1344 of 2017. The petitioner has no criminal antecedent and is in custody since 19.09.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Bodh Gaya P.S. Case No. 366 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
