====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-08-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, 34 of the Indian Penal Code.

It is alleged against the petitioner that the petitioner being Branch Manager of Bharat Capital Service Limited had impersonated the informant to invest in the company and on his persuasion, the informant invested Rs. 50,000/- in the company. The

No.20623 of 2021(9) dt.23-08-2022 2/3 informant also invested Rs. 50,000/- in the name of his wife and also persuaded other relatives of his family to invest in the company. However, on the date of maturity, when the informant went to encash his investment, this petitioner refused to pay the maturity amount and informant that the company had fled away and denied to share his liability for payment of maturity amount.

It is submitted by learned counsel for the petitioner that petitioner was only an employee of the company and he had no concern with the policy making process of the company. The petitioner never took money directly from any depositor. The informant was also an employee of the aforesaid company and he was well aware of the policy of the company.

Considering the fact that on the assurance of this petitioner that his money would not be duped, the informant not only invested his hard earned money but also persuaded other relatives to invest in the company

Patna High Court CR. MISC. No.20623 of 2021(9) dt.23-08-2022 3/3 but ultimately lost all his money, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail to the petitioner is hereby rejected.
