====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 23-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Chapra Muffasil P.S. Case No.298 of 2016 registered under Sections 188, 272 and 273/34 of the Indian Penal Code besides Sections 47, 47(a) and 47(c) of the Bihar Excise Act (Amendment), 2016. The accusation is that on receiving secret information about preparation of illicit liquor at Mangai Dih Misrawaliya of village-Brahmpur, the police reached there. On seeing the police party, while two persons succeeded to flee away but one Bhuwan Mahto was apprehended by the police, who disclosed the name of his two associates, including the petitioner, who succeeded to flee

On search, some instruments for preparation of illicit liquor and 35 liters illicit liquor were recovered by the police from there. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner was not apprehended by the police on the spot rather the name of the petitioner has been disclosed by Bhuwan Mahto, who was apprehended by the police. The petitioner having no criminal antecedent is in custody since 13.10.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran, in connection with Chapra Muffasil P.S. Case No.298 of 2015.
