In light of Government Resolution No. 2937, dated 31.03.2011, issued by the Finance Department, annexed as Annexure-5 to the supplementary affidavit, the petitioners' counsel submits that they have approached the Authorities claiming relief for promotion from Grade-IV to the Post of Lower Division Clerk ( for brevity 'LDC'). The petitioners' have approached the Director, Economics and Statistics Directorate, Bihar, Patna (Respondent No. 3) by representations,

The submission of the petitioners' counsel is that if the same is considered, in right earnest, the petitioners' are likely to receive the benefits, for which, they have filed the instant writ proceedings.

In view of the said submission, pendency of the writ application would serve no useful purpose. The same is, accordingly, disposed of with liberty to the petitioners to pursue their pending representations, as contained in Annexure-4 series to the writ petition, before Respondent No.3, by submitting a copy of this order. The Authority would be under legal obligation to take a decision, in accordance with law, within a period of three (03) months from the date of receipt/production of a copy of this order.
