The petitioner apprehends his arrest in Rivilganj P.S. Case No.336 of 2019 registered under Sections 341, 323, 498A, 379, 504 and 34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the petitioner is the husband of the complainant and the petitioner never demanded any dowry. The mother of the petitioner filed an application much prior to the filing of the present case, against the complainant before the Women Helpline, Gopalganj and thereafter a notice was issued to the

Patna High Court CR. MISC. No.20896 of 2021(2) dt.13-01-2022 2/2 complainant but the complainant did not appear as is evident from Annexure 2 and 2/1.

Considering the above facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Rivilganj P.S. Case No.336 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
