The petitioner has preferred this application for grant of regular bail in a case registered under section 364A of the Indian Penal Code.

As per the prosecution case, the 15 year old younger brother of the informant was kidnapped and a call of ransom was made on telephone.

It is submitted by learned counsel for the petitioner that the victim boy was recovered and his statement was recorded under section 164 Cr.P.C wherein the petitioner was not named. The name of the petitioner transpired in the confessional statement of co-accused Shashi Ranjan who has himself been enlarged on bail vide order dated 18.1.2019 passed in Cr. Misc. no. 44 of 2019. The petitioner is in custody since

Patna High Court CR. MISC. No.20574 of 2021(3) dt.15-11-2021 2/2 23.10.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with grant of bail to co-accused Shashi Ranjan on whose statement made before police the name of the petitioner transpired, the Court directs the petitioner to be enlarged on bail in connection with Patliputra P.S. Case no. 40 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge XIII, Patna.
