The petitioner is in custody in connection with Supaul P.S. Case No. 716 of 2020 for the offence under Section 366A/34 of the Indian Penal Code lodged on 16.10.2020 by Kanchan Kumari.

As per the allegation, the petitioner firstly married the elder sister of the victim girl, left her and later confessing that he is in love with her and wants to marry, took her away. Subsequently, he got her married to his cousin brother, Vikash Kumar.

Learned counsel for the petitioner submits that now he has already married the petitioner and no role to play in the matter.

Learned counsel for the informant, on the other hand,

Patna High Court CR. MISC. No.11199 of 2023(2) dt.10-05-2023 2/2 submits that a bare perusal of Section 164 of the Cr.P.C. would show that in 2018, immediately after marriage, he sent her sister back and thereafter in 2020, she was allured and taken to Haryana, got her married to Vikash Kumar and later even the said gentleman is not taking her away on the ground of dowry of Rs. 5,00,000/- and a motorcycle.

Taking into account the fact that the petitioner is the king-pin of the entire episode which resulted into the victim girl being taken to Haryana and further her marriage with one of his brother, Vikash Kumar, this Court, for the present, is not inclined to grant him the privilege of bail.

Accordingly, the petition stands rejected.
