The petitioner is accused in connection with Buxar (T) P.S. Case No. 321 of 2015, registered under Sections 324, 307, 302, 201, 34, 120(b) of the Indian Penal Code and under Section 27 of Arms Act.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that admittedly the petitioner used to reside in the house of Banshi Yadav, Naye Bazar, Buxar, where deceased and other F.I.R. named accused persons, who are students, were also residing in the said house for preparation of competitive examination. Further submission is that petitioner has falsely been implicated by the informant, who

Patna High Court Cr.Misc. No.55224 of 2015 (3) dt.01-02-2016 is co-villager of the petitioner, merely on suspicion as he was residing in the said house, where the deceased was also residing on rent. Moreover, in course of investigation, it has only come that co-accused Chandan Kumar Singh has confessed his guilt causing death of the deceased through firearm and on the basis of the confessional statement of co-accused, the pistol has also been recovered from the house of the Chandan Kumar Singh. Further, submission is that petitioner has no criminal antecedent and he is custody since 07.08.2015.

Having regard to the facts and the circumstances of the case, the above named petitioner, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S. Case No. 321 of 2015.
