2. This application for grant of anticipatory bail arises out of Konch Police Station Case No. 215 of 2024, disclosing offence under Sections 341, 323, 307, 337, 338, 504, 506 and 34 of the B.N.S.
3. The prosecution case, as per the First Information Report, is that on 18.05.2024, in afternoon, the petitioner along with other co-accused persons arrived at the house of the informant and started abusing. When informant protested, the petitioner assaulted with bamboo stick on his head due to which the informant sustained injury. The other coaccused persons also assaulted the family members of the

4. Learned Counsel for the petitioner submits that petitioner is having no criminal antecedent and he has falsely been implicated in this case due to land dispute between the parties who are agnates. Petitioner has a counter version and a case bearing Konch P.S. Case No. 209 of 2024 has been lodged by the mother of the petitioner which is prior in time to the present FIR. The present FIR is counterblast to the FIR lodged by the side of the petitioner. He further submits that from perusal of the impugned order, it would be evident that the injury sustained by the victims are simple in nature. The side of the petitioner has also sustained injury in Konch P.S. Case No. 209 of 2024.

Regards being had to submissions made by the parties taking into consideration the fact that both the parties are agnates, having land dispute, case and counter case is there and the injury sustained by the victims are simple nature, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs.
Patna High Court CR. MISC. No. 11722 of 2025(2) dt.03-04-2025 3/3 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Gaya, Bihar, in connection with Konch Police Station Case No. 215 of 2024, subject to the condition laid down under Section 482 (2) of the B.N.S.S.
