Heard learned Counsel for the petitioners and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Jagdishpur PS case no. 199 of 2024, disclosing offences punishable under Sections 341, 323, 504, 427, 307/34 of the Indian Penal Code.

The prosecution story, as per the First Information Report, is that on 10.06.2024 at about 5 pm, when the informant was standing near the gate of Jagdishpur Hata, petitioners along with 04 unknown persons came and started abusing. They also pressurized the informant to cast his vote for their party and when the informant showed his unwillingness, petitioner no. 1
Patna High Court CR. MISC. No.10550 of 2025(3) dt.10-06-2025 2/3 assaulted by iron rod on his head causing head injury and petitioner no. 2 assaulted on the hand and back of the informant. Accused persons also damaged the vehicle of the informant. 4.
Learned Counsel for the petitioners submits that petitioners have falsely been implicated in this case due to local village politics. Learned counsel further submits that there is case and counter case between the parties, inasmuch as petitioner no. 1 has filed Jagdishpur PS Case No. 198 of 2024 against the informant's side, which is prior in time. He also submits that injuries sustained by the victims are simple in nature.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that there is case and counter case between the parties and injuries sustained by the victims are simple in nature, I am inclined to grant the privilege of anticipatory bail to the petitioners. 6.
This application is, accordingly, allowed.

Let petitioners, abovenamed, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st,
