This application is for grant of bail in connection with Narkatiyaganj Rail P.S.Case No.21 of 2016 for the offence under Section 364A of the Indian Penal Code.
It is submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. and his name transpires only because of the fact that the Mobile number, which has been seized from the petitioner, ransom was made, however, the mobile number as mentioned in the F.I.R. does not tally with the aforesaid Mobile number. The petitioner has clean antecedent and he has remained in custody for about five months.
Heard learned A.P.P. also, who has opposed the prayer for
Patna High Court Cr.Misc. No.2926 of 2017 (3) dt.03-03-2017 2/2 bail, stating that there is strong circumstances against this petitioner and now the boy has also been killed. Having heard both sides. In view of the fact that there is strong circumstances against this petitioner, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of preferably one year.
With the aforesaid observation, this application is dismissed.
