====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-05-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant.

The petitioner apprehends his arrest in connection with Bahadurpur (Fekla O.P.) Police Station Case No.287 of 2018/G.R. No.1926 of 2018 registered under Sections 304(B)/34 of the Indian Penal Code.

The accusation is that the marriage of Preeti Devi, the sister of the informant, was performed with the petitioner in the month of February, 2016. Since after the marriage, the sister of the informant was being tortured by her in-laws for nonfulfillment of the dowry demand but, in the meantime, she gave

On 23.06.2018 at about 02.00 P.M., Hari Narayan Paswan, the father of the petitioner, informed the informant on his mobile about the death of his sister, then the informant went at the sasural house of his sister and found his sister lying dead on the cot and the sasural people of his sister were making preparation for her funeral. The informant saw the black mark on the neck of his sister. The informant claimed that his sister has been killed by folding the rope on her neck or any other mode by her sasural people due to non-fulfillment of the dowry demand. Learned counsel for the petitioner submits that, admittedly, the petitioner is the husband of the deceased, the sister of the informant.

The petitioner used to reside at Jamshedpur in connection with his service.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Darbhanga, in connection with Bahadurpur (Fekla O.P.) P.S. Case No.287 of 2018/G.R. No.1926 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
