2. The petitioner seeks regular bail in connection with Sikraul P.S. Case No. 100 of 2023, lodged on 23.09.2023 under Sections 376, 511, 506 of the Indian Penal Code read with section 18 of the POCSO Act.

3. As per the prosecution case, the FIR has been lodged against the sole petitioner against whom there is an allegation of rape and violation of POCSO Act with the grand daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that both the petitioner and informant are well known to each other. Counsel further submits that the

Patna High Court CR. MISC. No.11417 of 2024(2) dt.22-02-2024 2/2 antecedent of the petitioner is clean and he is in custody since 30.09.2023. Counsel also submits that charge-sheet has already been filed in this case.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the victim girl is aged about 10 years..

6. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, the prayer for regular bail of the petitioner in connection with Sikraul P.S. Case No. 100 of 2023, pending before the learned Additional District & Sessions Judge-VI-cum-Special Judge POCSO Act, Buxar is hereby rejected.
