1. Heard learned counsel for the parties.

2. The application of petitioner no.1 (Ram Sunari @ Ramsundari Devi), petitioner no.2 (Ghurani Devi) and petitioner no.4 (Singheshwar @ Sinheshwar Das) having been withdrawn vide order dated 3.6.2025, the instant application is confined to petitioner no.3 (Savita Devi) only.

2. The instant application has been filed by the petitioner (petitioner no.3 herein) for grant of anticipatory bail apprehending her arrest in connection with Manigachi P.S. Case no.195 of 2024 registered under sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant states that there was dispute between her daughter and the accused persons including the petitioner herein. At about 4 p.m. on the date of occurrence it is stated that the co-accused Maheshwar Das tried to commit rape on her daughter. Subsequently he assaulted her and cut her neck with a kuttikatna.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case because of dispute between the informant and the petitioner's family who are neighbours. It is further submitted that accepting the allegations levelled in the F.I.R., the sole/main allegation is against the husband of this petitioner namely Maheshwar Das and not the petitioner herein. The petitioner is an old lady having no criminal antecedent. She undertakes to cooperate in the case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner ie petitioner no.3 in the F.I.R., the material that has transpired in course of investigation and the petitioner being a lady not having any criminal antecedent, it is directed that the petitioner

No.9076 of 2025(4) dt.04-06-2025 3/3 namely Savita Devi in the event of her arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Manigachi P.S. Case no. 195 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Darbhanga.
