2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 25.5 litres of illicit liquor has been recovered from the motorcycle which belongs to petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case and no incriminating article has been recovered from the conscious possession of the petitioner.

5. Learned APP for the State has opposed the bail

6. Considering the quantity of recovery and the fact that petitioner is registered owner of the motorcycle from which the said recovery has been effected and also the fact that petitioner carries one criminal antecedent of similar nature, the prayer for anticipatory bail of the petitioner is rejected.
