JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 04-112015 on the accusation that he issued Sim to one unknown person using voter identity card of the informant.

The contention on behalf of the petitioner is that prior to institution of the present case, a theft was committed in the shop of the petitioner, for which, petitioner lodged Sasaram (Tilauthu) P.S. Case No. 1170 of 2015 and in the aforesaid theft, several documents and Sims of the shop of the petitioner, were taken away by the miscreants.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner

Patna High Court Cr.Misc. No.55027 of 2015 (2) dt.11-12-2015 2/2 named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sasaram (Tilauthu) P.S. Case No. 1235 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram.
