Petitioners seek bail in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.

The FIR was lodged on recovery of dead body of the son of the informant from a well. The head of the victim was downwards in the well.

Submission of learned counsel for the petitioners is that other co-accused Ram Praveen Singh and Ram Jee Singh against whom suspicion was there have already been allowed bail by a Co-Ordinate Bench of this Court in Cr. Misc. No. 27235 of 2019. Petitioners are in custody since 03.10.2018. Investigation of the case is already complete.

No.11857 of 2019(3) dt.07-05-2019 2/2 Learned counsel for the informant opposed the prayer for bail on the ground that during investigation it reveals that daughter of one of the petitioner was in love with the deceased which was not liked by the family members of the girl and commission of murder was result of that.

Since, there is no direct evidence against the petitioners, let them, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gaurichak Police Station Case No. 340 of 2017, with the following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. (Birendra Kumar, J) Rajan/Banti U T
