1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Section 366 of the Indian Penal Code.

3. The Investigating Officer of the case, in compliance of the order dated 22.08.2024, is present in the Court.

4. The Investigating Officer submits that the victim has been recovered and her statement has been recorded under Section 164 of the Cr.P.C. wherein she has stated that she was married to the petitioner in the Year 2021 and on account of dispute with her husband, she fled and went to the house of her

Patna High Court CR. MISC. No.18503 of 2024(5) dt.27-09-2024 2/2 aunt (mausi) and her aunt got her married to one Vikash and she is presently staying with Vikash with whom she has a child and she intends to stay with Vikash.

5. The learned counsel for the petitioner submits that petitioner, being husband, has been falsely implicated in the instant case as would manifest from the submission made by the Investigating Officer of the case.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Punaura P. S. Case No.35 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.

8. The personal appearance of the Investigating Officer of the case is dispensed with.
