The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 447, 341, 323, 427, 354(B), 504, 506 and 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that on 15.02.2018 at 3.00 P.M. when she was mending the Tulsi Chaura, when the accused persons including the petitioner came and damaged the Tulsi Chaura and thereafter, abused the informant and assaulted her with kicks and fists. It is next alleged that petitioner caught the informant and dashed her on the ground and further, tore her sari and blouse and

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. The petitioner is uncle of the informant and the relation has been concealed and the informant realizing her mistake on the intervention of the well-wishers and even compromised the case as has been stated in Para-8 of the anticipatory bail application. Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Banka P. S. Case No.126 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
