The petitioner is languishing in custody since 09.10.2018, in a case registered for the offences punishable under Section 414 of the IPC and Sections 20 and 22 of the N.D.P.S. Act. The prosecution case, as per the written report of Arvind Kumar Suman, A.S.I., Begusarai Town Police Station dated 08.10.2018, submitted to the Station House Officer, Begusarai Town Police Station, is to the effect that on the same day, during the patrolling duty and raid being laid for arrest of accused persons, a secret information was received that a miscreant, who use to sedate the passengers at the Railway Stations and commits theft of their articles, is standing at the Begusarai Railway Station, whereupon a raid was laid at the Begusarai
Patna High Court CR. MISC. No.10986 of 2019(2) dt.27-02-2019 2/2 Railway Station and one person was apprehended, who disclosed his name as Bhim Mahton, the petitioner. From the possession of the petitioner, total 21 sedative tablets were recovered.
It is submitted by learned counsel for the petitioner that only on the basis of suspicion, the accusation has been levelled against the petitioner and no passenger has made any complaint against the petitioner that he has sedated anyone. Learned APP submits that recovery has been made from the possession of the petitioner.
Considering the nature of recovery and the investigation already concluded, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned NDPS Case No. 21 of 2018, arising out of Begusarai Town P.S. Case No. 621 of 2018.
