The petitioner seeks regular bail in connection with Special Case No. 22 of 2019 arising out of Chowk P.S. Case No. 500 of 2018 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 90 litres of illicit country made Mahua liquor from the bank of river. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that the petitioner has a clean antecedent. Lastly, it is submitted that the petitioner is languishing in custody since 01.01.2019.

Having regard to the facts and circumstances of the

Patna High Court Cr.Misc. No.9256 of 2019(2) dt.18-02-2019 2/2 case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 22 of 2019 arising out of Chowk P.S. Case No. 500 of 2018.
