The petitioner seeks bail in connection with Hussainganj P.S. Case No. 1 of 2019 instituted for the offence under Section(s) 413/414/420/34 of the Indian Penal Code and 30(a)/36/41(a) of Bihar Prohibition & Excise Act, 2016. In the written report police has mentioned about the recovery from two motorcycles. It is alleged that from one motorcycle 17.280 litres of foreign liquor has been recovered and one person was apprehended who disclosed his name as Rakesh Kumar. It is further alleged that informant came at Chhapya Karashar and saw some persons were loading foreign liquor on motorcycle and apprehended three persons as named in the written report including this petitioner. Patna High Court Cr.Misc. No.9399 of 2019(2) dt.18-02-2019 2/2 that total 43.200 litres of foreign liquor has been recovered from possession of three persons including this petitioner. Petitioner is in custody since 02.01.2019 having clean antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II, Siwan in connection with Hussainganj P.S.
