The petitioner is accused in connection with Siwan Mahila P.S. Case No. 72 of 2015 registered under Section 366(A) and 372 of the Indian Penal Code and Section 12 of the POSCO Act, 2012.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that the petitioner, Ravi Kumar, Shatrughna Thakur and Rubi Kumari, niece of the informant, were detained at Mahila Police Station, Siwan, thereafter informant reached there and lodged F.I.R. It is further submitted that the statement of the victim has been recorded under Section 164 of the Cr.P.C., in which, she has not made any complaint against the
Patna High Court Cr.Misc. No.56344 of 2015 (2) dt.16-12-2015 petitioner and others and she also stated about moving from her house with the petitioner and others for Siwan. It is further submitted that the age of the victim has been assessed by the Medical Board between 17-18 years. It is further submitted that petitioner has no criminal antecedent and is in custody since 01.06.2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Siwan, in connection with Mahila P.S. Case No. 72 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
