The petitioner is accused in connection with Kuchaikot P.S. Case No. 264 of 2016, registered under Sections 30(a)(b)(c) of the Bihar Prohibition and Excise Act. The accusation is that, in course of patrolling, one Maruti car was intercepted by the police, which was driven by this petitioner. On search, 1345 bottles, each containing 200 ml, total 279 litres of country made liquors recovered from the Maruti car. Learned counsel for the petitioner submits that, in fact, petitioner was pedestrian on the road and he was apprehended by the police in suspicion condition while the driver of the said Maruti car was succeeded to flee away. It is further submitted that
Patna High Court Cr.Misc. No.6089 of 2017 (2) dt.06-03-2017 while petitioner searched but driving licence was not found from possession of the petitioner. It is further submitted that petitioner is in custody since 04.12.2016.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VII, Gopalganj, in connection with Kuchaikot P.S.
