JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 01-12-2015 Heard the petitioner in person and the State. Petitioner was initially granted arms licence for the Patna district and, thereafter, it was extended to the entire State of Bihar. Petitioner, who is Lawyer, appears in person and submits that he has to travel out of station for the purpose of profession and other purposes also and as such he has applied for extension of licence before the Divisional Commissioner. However, it appears that the

Patna High Court CWJC No.1900 of 2014 dt.01-12-2015 2/3 letter was issued to the petitioner vide Annexure E from the Collectorate, Patna under the signature of District Arms Magistrate, Patna directing him to submit certain documents. It appears from Annexure F of the counter affidavit that the Additional Collector, Patna has requested the Sr. Superintendent of Police to send his report in this regard. Learned counsel for the State submit that the same is yet to be received to the Collector. In above view of the matter, this writ application is being disposed of with a direction to the District Magistrate - cum - licensing authority, Patna to take necessary steps in this regard and forwarded this matter after receiving all the documents and report submitted after necessary inquiry to the respondent no.

2 the Principal Secretary, Department of Home, Bihar, Patna who shall take a decision in accordance with law and in terms of the Circular of the Ministry of Home Affairs, circulated vide letter dated 31st March, 2010, a copy of which has been produced by the petitioner at the time of hearing.

If concurrence is required for granting All India validity from Central Government then steps regarding that should also be taken by him.

It is expected that the entire process would be completed within a period of six months from the date of production
