JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2020 Petitioner seeks regular bail in connection with Bajpatti P.S. Case No. 278 of 2019 registered for the offence punishable under Sections 366A/34 of the Indian Penal Code. Prosecution case of kidnapping of minor daughter of the petitioner. Learned counsel for the petitioner is trying to draw the attention of the Court towards Annexure '2' which shows that she had married with the petitioner and ready to reside with him. She has disclosed her age 18 years. Heard learned A.P.P. also who has opposed the prayer for bail on the ground that she is found minor in the medical examination.

Having heard both sides, considering the fact that she is residing with her aunt and she disclosed her age 18 years, in view of the facts and circumstances, as stated above, let the

Case No. 278 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
