JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-08-2022 Learned counsel for the petitioners seeks permission to withdraw this petition, so far as petitioner no. 2 is concerned. Accordingly, in respect of petitioner no. 2, this petition is dismissed as withdrawn.

Heard learned counsel for the parties.

The petitioner no. 1 apprehends his arrest in a case registered for the offence under Sections 406, 420, 506, 504 of the Indian Penal Code.

It is submitted that from bare perusal of the F.I.R., it is apparent that entire allegation is against co-accused Navaj Miya (petitioner no. 2), who agreed to return the amount, which was deposited by the informant. So far as petitioner no. 1 is concerned, he has been made accused in this case merely because he is father of the petitioner no. 2.

No.10616 of 2022(2) dt.08-08-2022 2/2 Considering the general and omnibus nature of allegation and clean antecedent of petitioner, let the above named petitioner no. 1, in the event of his arrest/surrender within a period of six weeks from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Bhorey P.S. Case No. 295 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
