The petitioner seeks bail in a case registered under Sections 302 of the Indian Penal Code.

Allegedly, in sleeping condition, husband of the informant was attacked with sharp edged weapon by his elder brother, as a result of which, he died.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 10-02-2018. Charge sheet has already been submitted. The informant is not eye witness to the alleged occurrence. Merely suspicion has been raised against the petitioner. Case diary is available on record. There is no eye

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-IXth, Saran at Chapra in connection with Sessions Trial No. 559 of 2018 arising out of Bhagwan Bazar P.S. Case No. 130 of 2017 .
