Ms. Veena Kumari Jaiswal ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 28-09-2022 This application has been filed for modification of order dated 16.03.2020 passed in Criminal Miscellaneous No. 80125 of 2019.

The petitioner was granted anticipatory bail vide order dated 16.03.2020. One the conditions was that the court below would verify and assure itself regarding the criminal antecedent of the petitioner. If he is having clean antecedent, then his bail bond would be accepted. If he is found to be involved in any other case before filing of this application i.e. 05.12.2019 then his bail bond would not be accepted.

The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and his bail

Patna High Court CR. MISC. No.14289 of 2021(4) dt.28-09-2022 2/2 bond is not accepted since there was one case that is Sessions Trial No. 415 of 2002 in which the petitioner has been acquitted, vide order dated 10.01.2007, except that case there is no other case against the petitioner.

The learned court below shall verify and if it is found that the petitioner has been acquitted in that case and there was no other case against him except above-mentioned sessions trial, his bail bond shall be accepted.

With these observations/directions, this petition is disposed of.
