1. Heard learned counsel for the petitioner, learned A.P.P. for the State and Mr. Ajay Mishra learned counsel appearing on behalf of the opposite party no. 2.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 384 and 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that the prayer for anticipatory bail of Manoj Kumar, who is a seller of the land, has already been rejected by an order dated 01.04.2024 in Cr. Misc. No. 14286 of 2024 but then the petitioner is merely an identifier on the sale deed and he was completely unaware of the controversy involved in the case.
4. Mr. Ajay Mishra, learned counsel appearing on behalf of the opposite party no. 2 on instruction of opposite
Patna High Court CR. MISC. No.13043 of 2024(3) dt.01-04-2024 2/2 party no. 2 very fairly submits that he is not opposing the prayer for anticipatory bail of the petitioner.
5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ramkrishna Nagar P.S. Case No. 22 of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
