The petitioner, namely, Triveni Kumar, is in custody in Byepass P.S. Case No. 75 of 2015 under Sections 406/34 of the Indian Penal Code.
According to the prosecution case, the petitioner is a driver of Bolero Pick-Up Van and that he informed the owner of the said Van that some miscreants have looted the Bolero Pick-Up Van. The informant suspected that the petitioner is also involved in commission of the loot of Bolero Pick-Up Van. Learned counsel for the petitioner submitted that, in fact, on the same day, Daniyama P.S. Case No. 78 of 2015 was lodged against six persons, who were found to be in possession of the said Bolero Pick-Up Van.
Patna High Court Cr.Misc. No.55619 of 2015 (2) dt.15-12-2015 Perused the order of the District Judge and the allegation in the F.I.R. It appears that the suspicion against the petitioner is that he might have conspired with the accused persons. Admittedly, the Bolero Pick-up Van has not been found in possession of the petitioner and another case, which has been registered against the other accused persons, who were found in possession of the Bolero Pick-Up Van and are in cutody. Considering the above facts and circumstances of the case, I direct the petitioner, named above, to be released on bail on furnishing bail bond of Rs.5,000/- (Five Thousand Rupees) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Patna City in connection with Byepass P.S. Case No. 75 of 2015.
