The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code and section 27 of the Arms Act. Later on sections 395, 412 of the Indian Penal Code and section 25(1-b)a of the Arms Act were added in the FIR.

As per the prosecution case, 644 gm. of silver ornaments was recovered from possession of this petitioner. It is submitted on behalf of the petitioner that petitioner is not named in the FIR. No looted article has been recovered from possession of this petitioner. The seized silver ornaments, which is said to have been recovered from the possession of petitioner, belongs to family of the petitioner and not part of looted article and same has not been put on T.I.P. till

Patna High Court CR. MISC. No.10414 of 2022(3) dt.09-05-2022 2/2 date or identified by the informant. Petitioner is in custody since 18.11.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case No. 298 of 2021 (G.R. No. 1731 of 2021).
