2. The petitioner has preferred this application for grant of regular bail in connection with Sathi P.S. Case No. 177 of 2024 dated 14.09.2024 registered for the offences punishable u/ss 126(2), 115(2), 96, 352, 351(2) read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner is alleged to have kidnapped the minor grand-daughter of the informant with the intention to marry her. It is further alleged that when the informant went to the petitioner's house to inquire, the co-accused Lal Saheb and his family members abused and assaulted him. The informant apprehends that the accused persons are involved in the kidnapping of his grand-daughter.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case.

Patna High Court CR. MISC. No.12339 of 2025(2) dt.24-03-2025 2/2 The occurrence took place on 09.09.2024 but the F.I.R. was lodged on 14.09.2024 and there is no explanation for this delay. The victim is physically present in the court through her counsel and stated that she left her house on her own sweet will and solemnized marriage with the petitioner and they are living happily as husband and wife. It is further submitted that the petitioner has no concern with the alleged offence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 12.11.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, West Champaran, Bettiah in connection with Sathi P.S. Case No. 177 of 2024.

7. The application stands allowed.
